Old Jurmala lietotnes gala lietotāja licences līgums

Šis gala lietotāja licences līgums (līgums) ir noslēgts starp Jums un SIA “Pastaigas” un regulē šīs lietotnes, kas iegūta Apple App Store/Google Play, lietošanas noteikumus. Uzstādot lietotni “Old Jurmala” Jūs piekrītat līgumam. Ja Jūs nepiekrītat šī līguma nosacījumiem un noteikumiem, Jums nav tiesību lietot lietotni “Old Jurmala”.

1. Šīs līgums ir noslēgts starp Jums un SIA “Pastaigas”, nevis ar AS “Apple”/AS “Google”. Neskatoties uz iepriekš minēto, Jūs atzīstat, ka Apple/Google un tā meitasuzņēmumi ir šī līguma trešās puses un Apple/Google ir tiesības izmantot šo līgumu pret Jums. SIA “Pastaigas” nevis Apple/Google ir atbildīgs par lietotnes “Old Jurmala” saturu.

2. Privātums. SIA “Pastaigas” var ievākt informāciju, kas saistīta ar lietotnes “Old Jurmala” lietošanu, ieskaitot informāciju, kas saistīta ar Jūsi izmantoto ierīci. SIA “Pastaigas” ir tiesības izmantot šo informāciju tik tālu, cik tas neskar Jūsu identitāti – lai izmērītu lietotnes izmantošanu un tās veiktspēju.

3. Ierobežota licence. SIA “Pastaigas” piešķir Jums ierobežotu, neekskluzīvu, nepārsniedzamu, atsaucamu licenci lietotnes “Old Jurmala” izmantošanai Jūsu personīgajiem, nekomerciālajiem mērķiem. Jūs varat lietot lietotni “Old Jurmala” tikai Apple/Android ierīcēs, kuras Jums pieder vai kuras kontrolējat un tikai tā, kā atļauts App Store/Google Play pakalpojumu sniegšanas noteikumos.

4. Lietotne “Old Jurmala” ir piemērota visiem lietotāju vecumiem;

5. Garantijas. SIA “Pastaigas” pilnībā noraida visas garantijas, kas saistītas ar lietotni “Old Jurmala”, ciktāl to atļauj likums. Saskaņā ar likumu, ja pastāv garantija no kurām nevar atteikties, par šādām garantijām ir atbildīgs tikai SIA “Pastaigas”, nevis Apple/Google.

6. Uzturēšana un atbalsts. SIA “Pastaigas” nodrošina minimālu uzturēšanu vai atbalstu, taču gadījumos, kad apkopi vai atbalstu prasa piemērojamie tiesību akti, SIA “Pastaigas”, nevis Apple/Google, ir pienākums sniegt šādu apkopi vai atbalstu.

7. Pretenzijas. SIA “Pastaigas”, nevis Apple/Google, ir atbildīgs par visu Jūsu prasījumu izskatīšanu, kas saistīti ar lietotni “Old Jurmala” vai tās lietošanu, tostarp, bet ne tikai:

(i) jebkādas prasības, kas saistītas ar atbildību par produktu;

(ii) jebkādas pretenzijas kas saistītas ar to, ka lietotne “Old Jurmala” neatbilst jebkurām piemērojamām juridiskām vai normatīvām prasībām;

(iii) jebkura prasība, kas izriet no patērētāju aizsardzības vai līdzīgiem tiesību aktiem. Nekas šajā līgumā nav uzskatāms par atzīšanu, ka Jums varētu būt šādas pretenzijas.

8. Trešo pušu prasījumi par intelektuālo īpašumu. SIA “Pastaigas” nav pienākuma atlīdzināt Jums vai aizstāvēt Jūs jebkādu trešo personu prasību gadījumā, ja tās izriet vai ir saistīta ar lietotni “Old Jurmala”. Ciktāl SIA “Pastaigas” ir pienākums nodrošināt atlīdzību saskaņā ar piemērojamiem tiesību aktiem, SIA “Pastaigas”, nevis Apple/Google, ir pilnībā atbildīgs par visu šo prasību izmeklēšanu, aizstāvēšanu, noregulēšanu un izpildīšanu, ja lietotne “Old Jurmala” pārkāpj trešo personu intelektuālā īpašuma tiesības.

Old Jurmala App End User License Agreement

This End User License Agreement (“Agreement”) is between you and “Pastaigas” Ltd and governs use of this app made available through the Apple App Store/Google Play. By installing the “Old Jurmala” App, you agree to be bound by this Agreement. If you do not agree with the terms and conditions of this Agreement, you are not entitled to use the “Old Jurmala” App.

1. Parties This Agreement is between you and “Pastaigas” Ltd only, and not Apple, Inc. (“Apple”)/Google, Inc. (“Google”). Notwithstanding the foregoing, you acknowledge that Apple/Google and its subsidiaries are third party beneficiaries of this Agreement and Apple/Google has the right to enforce this Agreement against you. “Pastaigas” Ltd, not Apple/Google, is solely responsible for the “Old Jurmala” App and its content.
2. Privacy “Pastaigas” Ltd may collect and use information about your usage of the “Old Jurmala” App, including certain types of information from and about your device. “Pastaigas” Ltd may use this information, as long as it is in a form that does not personally identify you, to measure the use and performance of the “Old Jurmala” App.

3. Limited License “Pastaigas” Ltd grants you a limited, non-exclusive, non-transferable, revocable license to use the “Old Jurmala” App for your personal, non-commercial purposes. You may only use the “Old Jurmala” App on Apple/Android devices that you own or control and as permitted by the App Store/Google Play Terms of Service.
4. “Old Jurmala” is suitable for all ages;

5. Warranty “Pastaigas” Ltd disclaims all warranties about the “Old Jurmala” App to the fullest extent permitted by law. To the extent any warranty exists under law that cannot be disclaimed, “Pastaigas” Ltd, not Apple/Google, shall be solely responsible for such warranty.

6. Maintenance and Support “Pastaigas” Ltd does provide minimal maintenance or support for it but not to the extent that any maintenance or support is required by applicable law, “Pastaigas” Ltd, not Apple/Google, shall be obligated to furnish any such maintenance or support.

7. Product Claims “Pastaigas” Ltd, not Apple/Google, is responsible for addressing any claims by you relating to the “Old Jurmala” App or use of it, including, but not limited to:

(i) any product liability claim;

(ii) any claim that the “Old Jurmala” App fails to conform to any applicable legal or regulatory requirement;

(iii) any claim arising under consumer protection or similar legislation. Nothing in this Agreement shall be deemed an admission that you may have such claims.

8. Third Party Intellectual Property Claims “Pastaigas” Ltd shall not be obligated to indemnify or defend you with respect to any third party claim arising out or relating to the “Old Jurmala” App. To the extent “Pastaigas” Ltd is required to provide indemnification by applicable law, “Pastaigas” Ltd, not Apple/Google, shall be solely responsible for the investigation, defense, settlement and discharge of any claim that the “Old Jurmala” App infringes any third party intellectual property right.
